1. Acceptance of Terms

Welcome to ProofPrep. By accessing or using our website, services, or applications (collectively, the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Description of Service

ProofPrep is an AI-powered interview preparation platform that offers:

  • AI-simulated interview experiences
  • Real-time feedback on interview performance
  • Detailed performance analysis and recommendations
  • Interview recording capabilities (Pro plan feature)
  • Subscription-based payment plans through Lemon Squeezy
  • Cryptocurrency-based one-off credit purchases through DaimoPay/Base
  • Entry-level free plan with limited credits
  • Guided onboarding for new users

3. User Registration and Account Security

3.1 Account Creation

To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account

3.3 Age Restriction

You must be at least 5 years old to create an account. By creating an account, you represent that you are at least 18 years old.

4. Payment Services

4.1 Subscription Plans

ProofPrep offers various subscription plans, including:

  • Entry plan (free) with limited credits
  • Starter plan with additional features
  • Pro plan with premium features including interview recording and advanced benefits

4.2 Payment Processing

We offer two payment methods:

Subscription Payments:

  • Processed through Lemon Squeezy
  • Standard payment processing fees may apply
  • Transactions are secured using industry-standard encryption

Additional Credit Purchases:

  • Available via DaimoPay using cryptocurrency on the Base network
  • Requires connecting a Web3 wallet (Coinbase Wallet API v2)
  • Cryptocurrency transaction fees may apply based on network conditions

4.3 Digital Wallet Integration

For cryptocurrency payments:

  • ProofPrep integrates with Coinbase Wallet API v2
  • You are responsible for the security of your wallet credentials
  • Cryptocurrency transactions are generally irreversible

4.4 Refund Policy

Regarding refunds:

  • Subscription payments may be refundable within a specified period
  • Cryptocurrency payments for additional credits are generally non-refundable due to blockchain transaction limitations
  • Disputed transactions will be reviewed on a case-by-case basis
  • ProofPrep reserves the right to issue refunds at its sole discretion

5. User Conduct

You agree not to:

  • Use the Service for any illegal purpose
  • Attempt to gain unauthorized access to the Service or other users' accounts
  • Interfere with or disrupt the Service or servers
  • Upload viruses or other malicious code
  • Impersonate another person or entity
  • Collect or track personal information of other users
  • Use the Service in any manner that could disable, overburden, or impair the Service

6. Intellectual Property Rights

6.1 Content Ownership

All content on the Service, including text, graphics, logos, and software, is the property of ProofPrep or its licensors and is protected by copyright and other intellectual property laws.

6.2 User-Generated Content

By submitting content to the Service (including interview responses):

  • You grant ProofPrep a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content for the purpose of providing and improving the Service
  • You represent that you have all necessary rights to grant this license
  • You understand that your content may be used to improve our AI systems

7. Privacy and Data Security

7.1 Data Collection

We collect and process personal data as described in our Privacy Policy. By using the Service, you consent to such processing and you represent that all data you provide is accurate.

7.2 Interview Recordings

When using our interview simulation features:

  • Your audio may be recorded and stored for feedback and improvement purposes
  • Recordings are used to provide you with personalized feedback
  • You may delete your recordings at any time through your account settings

7.3 Onboarding Data

During the onboarding process:

  • We collect information about your usage preferences
  • This data is used to personalize your experience
  • Your onboarding status is saved to your user profile

8. Subscription and Credits

8.1 Credit System

ProofPrep operates on a credit-based system:

  • Credits are allocated based on your subscription plan
  • Entry (free) plan includes 3 credits
  • Credits may expire based on your subscription terms
  • Credits are replenished according to your subscription schedule

8.2 Subscription Changes

ProofPrep reserves the right to:

  • Change pricing and credit allocation at any time
  • Modify or discontinue specific features or the entire Service
  • Users will be notified of significant changes to the credit system

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROOFPREP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR USE OR INABILITY TO USE THE SERVICE
  • ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN
  • ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICE
  • ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH THE SERVICE

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

PROOFPREP DOES NOT WARRANT THAT:

  • THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE
  • DEFECTS WILL BE CORRECTED
  • THE SERVICE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS
  • THE INTERVIEW SIMULATIONS WILL EXACTLY MATCH ACTUAL INTERVIEW EXPERIENCES
  • FEEDBACK PROVIDED WILL GUARANTEE JOB INTERVIEW SUCCESS

11. Termination

ProofPrep may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Changes to Terms

ProofPrep reserves the right to modify or replace these Terms at any time. Material changes will be notified through the Service or by email. Your continued use of the Service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by the laws of [Jurisdiction], without regard to its conflict of law provisions.
